A PERSON’S 14 YEARS’ WORK RECORD WAS RESTORED

On July 2022 citizen S.S. applied to New Generation Humanitarian NGO. The citizen reported that she has 45 years’ work record and applied to the Regional Department of the Social Security for retiring pension. The citizen submitted the Social Security employees her work record book where the person’s 45 years’ employment history was mentioned. However, the Social Security employees didn’t take into account the citizen’s 14 years’ work record as date of those years was not preserved in the archives. 

Lawyer of New Generation Humanitarian NGO provided the person with legal consultation and prepared and submitted official letters to the Minister of Labour and Social Affairs of the Republic of Armenia.  

As a result, S.S.’s retiring pension was counted in accordance with her 45 years’ employment history. 

 

Clarifications: 

According to the Article 32 of the law of the Republic of Armenia on State Pensions:  

  1. The service record book or any other document identified by the Government of the Republic of Armenia shall serve as the main document certifying the length of service for the period until January 1, 1992.

1.1. The service record book or any other document identified by the Government of the Republic of Armenia shall serve as the main document certifying the length of service  for the period from January, 1992 through January 1, 2013… 

  1. For the period following January 1, 2013 the length of service shall be validated based on the data included in the database as specified in this Law.

3. In the absence of the service record book or the respective records therein or other documents identified by the Government of the Republic of Armenia, an archive proof shall serve as a basis for validating the length of service. In the absence of such a proof, the length of service shall be determined by the court.
