RA PROSECUTOR’S OFFICE SATISFIES COMPLAINT FROM NEW GENERATION HUMANITARIAN NGO
On August 19, 2020, New Generation Humanitarian NGO applied to the Prosecutor’s General Office of the Republic of Armenia to recognize the violation of the rights and freedoms of R.K., instructing the investigative body to prepare materials for initiating a criminal case.
As a result, by the letter of August 26, 2020, Arabkir and Kanaker-Zeytun Administrative Districts of the RA Prosecutor’s Office instructed Kanaker-Zeytun Division of Yerevan City Department of the RA Police to report a crime on the report submitted by R.K., prepare materials and solve the process in the manner prescribed by Articles 180-181 of the RA Criminal code.
Pre-history of the case
On March 16, 2020, citizen R.K. applied to New Generation Humanitarian NGO as he was refused surgery at IZMIRLYAN medical center, learning about his HIV positive status.
New Generation Humanitarian NGO submitted a written complaint to the RA Ministry of Health, the Health and Labor Inspectorate and submitted a report on the crime to the RA Police.
On April 20, 2020, R.K. visited the Kanaker-Zeytun Division of the Yerevan city Department of the RA Police together with the attorney provided by New Generation Humanitarian NGO and gave an explanation.
According to the August 8, 2020 letter of the Kanaker-Zeytun Division of the Yerevan City Department of the RA Police, based on the report submitted by NGNGO, any factual data on intentional non-provision of medical care to the R.K. was not received, so the letter was left without results and was attached to the secretariat with conclusion. No materials were prepared in accordance with Articles 180-181 of the RA Criminal Procedure Code, as the circumstances mentioned in the letter of 17-03-2020 were discussed as information in need of verification.
