ADMINISTRATIVE PROCEEDINGS HAVE BEEN INITIATED IN CONNECTION WITH THE REFUSAL TO PROVIDE MEDICAL CARE TO A PERSON LIVING WITH HIV IN THE IZMIRLYAN MEDICAL CENTER

On April 22, 2020, RA Health and Labor Inspection Body initiated administrative proceedings based on the letter from New Generation Humanitarian NGO to check the compliance of the entries in the medical documents of citizen R. Kh. completed, maintained and circulated at Izmirlyan Medical Center CJSC on March 16, 2020,  with the requirements of Clause 6 of the first part of Article 19.3 of the RA Law on medical assistance and service to population, Sub-clause 1 of Clause 1 of N 02-Ն order by RA Minister of Health օn the approval of the format of medical documents used in hospital medical organizations adopted on February 14, 2014.

 

 

Clarification

Clause 6 of the first part of Article 19.3 of the RA Law on medical assistance and service to population:

The medical workers are obliged to complete, maintain and circulate the medical documents, as well as record the medical interventions in the manner prescribed by the legislation of the Republic of Armenia.

 

Sub-clause 1 of Clause 1 of N 02-Ն order by RA Minister of Health on the approval of the format of medical documents used in hospital medical organizations adopted on February 14, 2014.

The pre-history of the case

On March 16, 2020, citizen R.K. applied to New Generation Humanitarian NGO, informing that he had been refused to be operated on at IZMIRLYAN medical center due to his HIV positive status. The doctors justified the refusal with a statement that people with HIV-positive status should be kept separate and their hospital did not have separate free beds at the moment.

 

New Generation Humanitarian NGO submitted a written complaint to the Ministry of Health, the Health and Labor Inspectorate of the Republic of Armenia and reported the crime to the RA Police.

 

On March 25, 2020,  Health and Labor Inspectorate of the Republic of Armenia requested documents about the initiation of administration proceedings and about examination at Izmirlyan medical center which were thereby provided.
