Discriminatory Treatment at a Polyclinic Based on the Patient’s Sexual Orientation

On April 8, 2025, A.H. visited their new local polyclinic for medical examinations. During the consultation, the doctor decided to refer A.H. to a specialist based on their medical concerns. 

During the visit, A.H. inquired about a previously recorded visit listed under their name in the “Armed” electronic system, of which they had no knowledge. At the doctor’s request, A.H. showed their personal “Armed” profile, which—among other personal data—included a note indicating their sexual orientation. 

Upon seeing this, the doctor’s attitude toward A.H. abruptly changed. Speaking in a harsh tone, the doctor told A.H. there was no need for any referral and that they could leave. Confused by the sudden shift in behavior, A.H. asked for an explanation. Instead of providing one, the doctor began shouting and then expelled A.H. from the room, stating they would no longer provide any services to them. 

At that moment, A.H. contacted New Generation Humanitarian NGO (NGNGO). An NGNGO lawyer immediately reached out to the polyclinic’s administration and the doctor. As a result of the discussion, the referral was eventually provided to A.H., and the doctor issued an apology for their conduct. 

 

Important Note: 

According to Armenian Government Decree No. 404, homosexuality is classified as a mental and behavioral disorder, which can serve as a basis for exemption from military service. The diagnosis is issued by a psychiatrist. 

Classifying homosexuality as a mental disorder and including this information in the “Armed” system violates human dignity, the right to personal data protection, and contradicts both Armenian legislation and the World Health Organization’s International Classification of Diseases, which removed homosexuality from the list of mental disorders in 1990.
